CONTENT UPLOAD AGREEMENT & CREATOR TERMS

This Content Upload Agreement ("Agreement") governs the relationship between 4Men.fun ("the Company") and any user who uploads, posts, or submits visual content, including but not limited to videos and images (the "Content"), to the platform.
1. REPRESENTATION OF AGE AND CONSENT
By uploading Content, you represent and warrant that:
  • Verification: You have successfully passed the mandatory Age Verification process on 4Men.fun.
  • Legal Age: Every person depicted in the Content was at least 18 years of age at the time the Content was created.
  • Consent: Every person depicted has provided their express, written, and informed consent to be filmed and for that Content to be distributed on 4Men.fun. You must maintain these "Model Releases" and provide them to the Company immediately upon request.
2. OWNERSHIP AND LICENCE GRANT
  • Retained Ownership: You retain the copyright to your original Content.
  • Licence to 4Men.fun: By uploading, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual, and sub-licensable licence to host, cache, store, reproduce, distribute, and display the Content on the platform and for promotional purposes related to 4Men.fun.
3. PROHIBITED CONTENT (ZERO TOLERANCE)
You are strictly prohibited from uploading Content that contains:
  • Non-Consensual Imagery: Content recorded or uploaded without the participant's knowledge or consent (e.g., "revenge porn").
  • Illegal Acts: Content depicting violence, non-consensual sexual acts, or any other illegal activity.
  • Third-Party Material: Content you do not own (e.g., clips from professional studios or other websites) without written authorisation.
  • Minor Protection: Any content involving or appearing to involve minors. Violations will result in an immediate ban and reporting to international law enforcement (NCMEC/INHOPE).
4. COMPLIANCE WITH 18 U.S.C. § 2257
You acknowledge that you are the "Primary Producer" of the Content for the purposes of U.S. federal record-keeping laws. You certify that you maintain all required records for every performer in your Content at your own location and will produce such records for inspection by the Company or government authorities if requested.
5. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless 4Men.fun and its officers from any claims, damages, or legal fees arising from your breach of this Agreement, including claims of copyright infringement or lack of performer consent.
6. REMOVAL OF CONTENT
The Company reserves the right, at its sole discretion and without prior notice, to remove any Content that is reported as illegal, non-consensual, or in breach of these Terms.
7. DISPUTE RESOLUTION
This Agreement is governed by the laws of Portugal. Any disputes arising from the uploading of content shall be resolved in the courts of Lisbon.
